This module introduces a framework for the resolution of international disputes. It examines from a comparative perspective, various methods of resolving disputes. This module draws on learners’ prior knowledge and understanding of domestic and international disputes. It engages critical issues in both domestic and international law. The module assesses the international methods of dispute resolution in relation these issues. Students will be provided with a critical understanding of the most important aspects of international negotiation, mediation commercial arbitration, the characteristics of arbitration and its operation in various international fora. Particular attention is given to the central processes of arbitration, negotiation and mediation, identifying the overall nature of the various methods of Alternative Dispute Resolution (ADR), progressing ADR methods through a series of steps and decisions including, where appropriate, drafting documentation.
